Please read the folowing terms and conditions of use, before using simoneta.com website. Users of this site agree that access and use of simontea.com are subject to the applicable law and terms and conditions. Please do not use simontea.com web site if you do not agree to these terms and conditions. 

 

ORDERS
When you place an order online, you will have the opportunity to check the details of your order and correct any errors before placing the order. When you place your order you are making an offer to buy. You will be sent an e-mail (“ACKNOWLEDGEMENT OF ORDER”) confirming receipt of your order from PayPal  The ACKNOWLEDGEMENT OF ORDER is not acceptance of your offer. If your offer has been accepted you will be contacted by us via e-mail confirming the details of your order (“ORDER CONFIRMATION”). At this time your offer to buy will have been accepted and a legally binding contract will be formed and your order will be despatched to you.
By using the services provided by www.simontea.com you agree to abide by our terms and conditions as set out on this page and on this website. These terms and conditions apply to all products purchased from this website.

SUBSTITUTION POLICY

We try hard to always send the gift basket as shown on our web site. Sometimes items and containers may be no longer available. We reserve the right to substitute products and containers with items of equal or greater value.

 

RETURN POLICY

 No returns on undamaged food baskets and goods. Shipping and delivery charges are not refundale

REPLACEMENT OF DAMAGED GIFT BASKETS

Please report any damaged shipment to us within 2 business days of a basket arriving. If a basket arrives damaged, we will be more then happy to arrange an exchange replacement. Please call us at 1-416 421 7437  . Please be sure to keep all damaged packing. Once the iteam has been received by us, we will issue a replacement.

We are not responsible for damages that are not reported to us within 2 business days.

 

COMPLAINTS

We aim to deliver the highest level of customer service. However, if you feel you would like to complain about any matter please e mail sales@simontea.com.  We will reply as soon as possible .You will receive an acknowledgement within 3 (three) working days whilst we work to resolve your complaint.

MAXIMUM LIABILITY

If, notwithstanding the foregoing, The Simontea Gift Basket Company (part of DS Sound inc) or any of the Third Parties should be found liable for any loss or damage which arises out of or is in any way connected with any of the functions or uses of simontea.com or its content, the liability of The Basket Company and the Third Parties shall in no event exceed in the aggregate $100 CAD.
 
GOVERNING LAW
You agree that the laws of the Province of Ontario shall apply to these Terms and Conditions and you attorn to the jurisdiction of the Province of Ontario for resolution of all disputes.
